Terms of Service

1. Acceptance of Terms

By accessing or using consulti.ai (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all visitors, registered users, and subscribers.

2. Description of Service

Consulti is a B2B lead search and email deliverability platform. We provide access to a database of business professional contact information and a suite of email deliverability tools. The Platform is intended for legitimate business-to-business outreach purposes only.

3. Account Terms

• You must be at least 18 years old and capable of forming a binding contract to use this Platform.
• You must provide accurate, complete, and current information when creating your account.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• One person or entity may not maintain more than one free account.
• You must notify us immediately at support@consulti.ai if you suspect unauthorized access to your account.

4. Acceptable Use of Data

Data accessed through the Platform is provided for legitimate B2B outreach purposes. When using our lead data, you agree to:

• Comply with all applicable laws, including CAN-SPAM (United States), GDPR (European Union), CASL (Canada), and any other relevant email marketing and data protection regulations in your jurisdiction.
• Not send unsolicited bulk email (spam).All outreach must be targeted, relevant to the recipient's business, and include a clear unsubscribe mechanism.
• Honor opt-out requests promptly. You must process unsubscribe requests and cease contact with individuals who have opted out.
• Not resell, redistribute, or sublicense any data obtained from the Platform to third parties.
• Not scrape, crawl, or systematically extract data from the Platform using automated means beyond the provided API and export features.
• Not use data for discriminatory, harassing, or illegal purposes including but not limited to identity theft, phishing, or fraud.
• Include accurate sender information in all outreach emails, including a valid physical mailing address and a clear identification of the sender.

Violation of these terms may result in immediate account suspension or termination without refund.

5. Credits and Usage

• Access to lead data is governed by a credit system. Each plan includes a monthly credit allocation.
• Unused credits do not roll over to the following billing period unless explicitly stated in your plan.
• Credit packs are non-refundable once purchased and do not expire.
• Free accounts are subject to weekly usage caps in addition to monthly limits.
• We reserve the right to modify credit allocations, pricing, and plan features with 30 days' notice.

6. Payment Terms

• Paid subscriptions are billed in advance on a monthly or annual basis through Stripe.
• All fees are quoted in US dollars and are non-refundable except where required by law.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect on their account.
• Failed payments may result in service suspension. We will attempt to notify you before suspending access.

7. Intellectual Property

The Platform, including its design, code, features, and branding, is the property of Consulti and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our written permission.

8. Data Accuracy Disclaimer

While we make reasonable efforts to maintain accurate and up-to-date B2B contact data, we do not guarantee the accuracy, completeness, or reliability of any information in our database. Business information changes frequently and data may become outdated. You are responsible for verifying the suitability of any data before use in your campaigns.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Consulti and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Platform. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Consulti harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable law — including but not limited to claims arising from your email outreach activities using data obtained through the Platform.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, including but not limited to misuse of lead data, abusive behavior, non-payment, or any activity that threatens the integrity of the Platform. You may terminate your account at any time through your account settings or by contacting support@consulti.ai.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users by email at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
